Internet Marketing Muscle MAKES NO PROMISES, REPRESENTATIONS, OR WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE PRODUCTS, SERVICES, OR INFORMATION, INCLUDING BUT NOT LIMITED TO:

  • Their condition or performance
  • Their conformity to any description or representation
  • The existence of any defects (latent or patent)

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES (IF ANY), INCLUDING:

  • Title

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Internet Marketing Muscle OR ITS SUPPLIERS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, OR EXEMPLARY DAMAGES ARISING FROM OR IN ANY WAY RELATED TO:

  • The use of (or inability to use) our products, services, or information
  • The provision of or failure to provide support or updates
  • Lost profits, loss of business, or loss of data
  • Personal injury, loss of privacy, or business interruption
  • Negligence or failure to meet a duty of good faith or reasonable care
  • Costs of substitute goods or services
  • Any claim made against the user by a third party

This limitation applies even if Internet Marketing Muscle has been advised of the possibility of such damages, and regardless of any failure of essential purpose of any limited remedy.

Maximum Liability

Notwithstanding any damages you may incur, the entire liability of Internet Marketing Muscle and its suppliers under any provision of this Agreement, and your exclusive remedy, shall be limited to the greater of:

  1. The actual amount paid by you for the products, services, or information; or
  2. One U.S. Dollar (USD $1).

These limitations, exclusions, and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails of its essential purpose.

Severability

If any provision of this Disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Modifications

Internet Marketing Muscle reserves the right to modify this Disclaimer at any time. Updates will be posted on this page with a revised effective date. Continued use of our websites, products, or services after changes have been made constitutes acceptance of the updated terms.
